Liability of Service Providers for Global Navigation Satellite Systems

Abstract

Although Global Navigation Satellite Systems (GNSS) provide precise and accurate services, it is technically possible that any delay in sending signals or sending them incompletely or interruption of services cause damage. Navigation of aircrafts by Global Navigation Satellite Systems creates a variety of questions about the liability of service providers which international air and space law conventions are not sufficient for the answers. Maybe at first, attempting to ratify an international Convention in Global Navigation Satellite Services is the best option but at the same time, experience of time-consuming efforts to drafting an international convention regarding to liability of Air Traffic Control, makes clear the difficulties. Author believes that International Civil Aviation Organization (ICAO) as one of the active international organizations in the aviation industry can play a major role in various aspects of the implementation of satellite systems like liability of service providers by creation an appropriate legal framework.
