مسئولیت مدنی ارائه‌دهندگان خدمات سامانه‌های ماهواره‌ای هدایت هواپیما

چکیده

اگرچه سامانه‌های ماهواره‌ای هدایت هواپیما، خدمات ناوبری را در نهایت دقت و صحت ارائه می‌کنند اما در هر حال از لحاظ فنی این امکان وجود دارد که تأخیر در ارسال سیگنال‌ها و یا ارسال آن‌ها به طور ناقص و یا قطع خدمات منجر به بروز خسارت گردد. هدایت هواپیماها در سطح جهانی از طریق سامانه‌های مذکور، مسائل مختلفی در خصوص مسئولیت ارائه‌دهندگان خدمات ایجاد می‌کند که کنوانسیون‌های موجود در حقوق بین‌الملل هوایی و فضایی از جمله کنوانسیون 1944 شیکاگو، معاهده 1967 فضای ماوراء جو و کنوانسیون 1972 مسئولیت، پاسخگوی آن نیست. در وهلة نخست، انعقاد یک کنوانسیون بین‌المللی جدید برای حکومت بر این حوزه، راه‌حل مناسبی به نظر می‌رسد اما تجربة تلاش‌های طولانی و نافرجام در تصویب یک کنوانسیون بین‌المللی در خصوص مسئولیت کنترل ترافیک هوایی، دشوار بودن این مسیر را بیش از پیش مبرهن می‌سازد. بهترین راهکار آن است که ایکائو به عنوان یکی از سازمان‌های بین‌المللی فعال در صنعت هواپیمایی، با ایجاد یک چارچوب حقوقی مناسب، ابعاد و مسائل مختلف ناشی از اجرایی شدن سامانه‌‌های ماهواره‌ای هدایت هواپیما از جمله مسائل مستحدثه مربوط به مسئولیت ارائه‌دهندگان این خدمات را قانونمند نماید.

چکیده [English]

Although Global Navigation Satellite Systems (GNSS) provide precise and accurate services, it is technically possible that any delay in sending signals or sending them incompletely or interruption of services cause damage. Navigation of aircrafts by Global Navigation Satellite Systems creates a variety of questions about the liability of service providers which international air and space law conventions are not sufficient for the answers. Maybe at first, attempting to ratify an international Convention in Global Navigation Satellite Services is the best option but at the same time, experience of time-consuming efforts to drafting an international convention regarding to liability of Air Traffic Control, makes clear the difficulties. Author believes that International Civil Aviation Organization (ICAO) as one of the active international organizations in the aviation industry can play a major role in various aspects of the implementation of satellite systems like liability of service providers by creation an appropriate legal framework.
